1. Acceptance of Terms
By accessing or using Promoter in a Box (“POX”, “the Service”, “we”, “us”, or “our”) at promoterinabox.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.
2. Account Creation
To use the Service you must create an account by providing a valid email address and password. You agree to:
- Provide accurate and complete registration information.
- Maintain the security of your password and accept responsibility for all activity that occurs under your account.
- Notify us immediately at team@promoterinabox.com of any unauthorized use of your account.
- Not create more than one account per person or use another person's account without permission.
You must be at least 13 years of age to create an account. Accounts created by individuals under 18 require parental or guardian consent.
3. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party platform terms of service (including those of Spotify, YouTube, TikTok, Twitch, SoundCloud, Shopify, Fourthwall, or Spring).
- Attempt to gain unauthorized access to any part of the Service, its servers, or any connected systems.
- Reverse engineer, decompile, or disassemble any portion of the Service.
- Transmit malware, viruses, or any code designed to disrupt, damage, or interfere with the Service.
- Scrape, crawl, or systematically extract data from the Service without our prior written consent.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
4. Third-Party Platform Connections
The Service allows you to connect third-party platform accounts via OAuth. By connecting a third-party account, you authorize POX to access data from that platform on your behalf using read-only scopes. You represent that you have the authority to grant such access.
Your use of connected platforms remains subject to those platforms' own terms of service and privacy policies. We are not responsible for any actions taken by third-party platforms, including changes to their APIs, scope restrictions, or account suspensions.
5. Intellectual Property
The Service, including its design, code, and content, is owned by Promoter in a Box and protected by applicable intellectual property laws. You retain all rights to your own data retrieved through connected platforms. You grant us a limited license to store and display that data solely for the purpose of providing the Service to you.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY DATA RETRIEVED FROM THIRD-PARTY PLATFORMS WILL BE ACCURATE OR COMPLETE.
7. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PROMOTER IN A BOX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100).
8. Account Termination
By you: You may delete your account at any time by contacting us at team@promoterinabox.com. Upon deletion, all your personal data and stored OAuth tokens will be permanently removed.
By us: We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent or illegal activity, or if continued provision of the Service to you is no longer commercially or technically feasible. Upon termination, your right to access the Service ceases immediately.
9. Changes to These Terms
We may revise these Terms at any time. We will notify you of material changes by updating the “Last updated” date above. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in the United States.
